Tusk Photography

By booking a session and submitting a retainer, the Client agrees to the following terms and conditions:

SERVICES

The Photographer agrees to provide photography services as outlined in the selected session type. The Photographer will make a good-faith effort to achieve the Client’s desired results while maintaining full creative discretion regarding style, composition, and editing.

RETAINER & PAYMENT

• A 50% non-refundable retainer is required at the time of booking to secure the session and time.

• The remaining balance is due on or before the day of the session, prior to delivery of images.

• Retainers are transferable one time in the event of rescheduling.

• No image will be delivered until full payment is received.

CANCELLATION & RESCHEDULING

• If the Client cancels the session, the retainer is forfeited.

• If the Client reschedules, the retainer may be applied to a new date one time, subject to availability.

• The Photographer reserves the right to reschedule due to illness, weather, emergency, or unforeseen circumstances.

SESSION TIME & ADDITIONAL FEES

• Session time includes shoot time only. Editing time is not billed separately.

• Additional time requested beyond the scheduled session will be billed at $75 per additional 30 minutes, subject to availability.

• Traveling outside of the Columbus, Ohio area may incur an additional fee.

IMAGINE DELIVERY

• Final images will be delivered via a private online gallery. Galleries will remain active for 30 days from delivery date.

• It is the Client’s responsibility to download and back up all images prior to gallery expiration. The Photographer is not responsible for images once the gallery has expired.

• Raw, unedited images are not included and will not be provided under any circumstances.

• Final images will be delivered digitally within a reasonable timeframe discussed at booking.

• The Photographer retains full copyright to all images created.

• The Client is granted personal-use for downloaded images.

• The Photographer may use images for portfolio, website, social media, marketing, and promotional purposes unless otherwise agreed upon in writing.

CLIENT CONDUCT

The Photographer reserves the right to terminate the session and leave the location if the Client or any participants display abusive, threatening, or disrespectful behavior. If this occurs, the session will end immediately and all payments, including the retainer, will be forfeited.

LIABILITY

The Photographer is not responsible for circumstances beyond their control, including but not limited to weather conditions, venue restrictions, uncooperative subjects, or missed shots due to factors outside of Photographer’s control.

AGREEMENT

By submitting a retainer, the Client acknowledges that they have read, understood, and agree to the terms and conditions. The Client will also be asked to sign a copy of this agreement the day of their shoot.
